In the last few years, India has tightened its regulations on surrogacy. There are specific eligibility criteria that have been delineated by the amended Surrogacy (Regulation) Act, which include:

For Intended Parents:

  • Husband-wife owns properties in one or both of their names (married for a minimum of 5 years at least)
  • You need a certificate by an appropriate authority describing the medical condition of the intending mother making it traumatic or impossible to continue with pregnancy
  • Selection for single intended parents includes those who are widowed and divorced between 35-45 y/o
  • Women – ages 23-50; Men – ages 26-55

For the Surrogacy Mother:

  • Do be a close relation of the couple concerned
  • Age between 25-35 years
  • It would be nice if she had at least one of her children
  • Will be used as a surrogate just one time in her life
