Bringing Your Surrogacy Baby Home

Bringing Your Surrogacy Baby Home

The moment for which you’ve been preparing – through IVF cycles, consultations with a fertility specialist, legal documents and waivers filed and signed, many sleepless nights – has arrived. Your baby is born. Now comes the part not often enough discussed: getting them home. If your journey was IVF and surrogacy together or the first step was surrogacy, your transition home is a process. Which likely deserves just as focused attention.

The First 24-72 Hours Post Birth

And this is a window that is not just emotional – it’s procedural. Here’s what typically happens:

  • The surrogate mom does sign consent forms that she gives away her parental rights (according to your surrogacy agreement as well as surrogacy laws in India)
  • When a court order exists, the hospital issues the birth certificate, and your name appears on it
  • Your surrogacy doctor arranges for your history of activity to be given to the legal group for discharge
  • If you are travelling back from abroad, your baby passport and VISA process start at the same time

At Ekmi Fertility the process is a little different, our coordinators are in this with you – not just the medical team but someone who knows your case intimately and personally.

Legal Steps You Cannot Skip

Surrogacy laws in India have evolved. Under current regulations:

  • Only altruistic surrogacy is permitted
  • The intended parents must be Indian citizens
  • Prior to or shortly after birth, a court order must be obtained for the purpose of establishing legal parenthood, such as through surrogacy agreements
  • The law requires that all agreements be registered in order for the surrogate mother to have adequate insurance coverage

Without paperwork all of the above is postponed. We’ve observed families waiting longer than necessary simply because the legal steps were made a side note to “figure out later.” Don’t let that be you.

Practical Things to Prepare

Ensure that you have before getting discharged:

  • You have a pediatrician that is aligned with your beliefs in regards to your baby coming through gestational surrogacy
  • Newborn care plan (feeding, sleep, visits / checkups)
  • Emotional support – for you, not only the baby. And this change arrives differently than you would imagine most people
  • If international, confirmed travel clearances and medical fitness certificate for the infant
